This legal disclaimer and information (hereinafter the "Legal Notice") governs the use of the website: www.securityparking.repsol.com (hereinafter the "Booking Site"). We recommend that you read these Terms and Conditions carefully before using the Booking Site.

In order to comply with Law 34/2002, of 11 July, on Information Society Services and E-Commerce, the general information regarding this website is listed below:

I.- Users

Access and/or use of the Booking Site grants the condition of user, said user accepting from that moment, fully and with no reservations whatsoever, these General Terms and Conditions as well as the Terms and Conditions of Use of the parking service, when he or she makes a booking through the Booking Site.

Likewise, use of the Booking Site is subject to all notices, regulations for use and instructions, made known to the user by Repsol or the Operator of the parking installation insofar as they replace, complete and/or modify these Terms and Conditions.

Repsol may modify these General Terms and Conditions, which shall be published on the Booking Site through the corresponding notice. Modifications shall not be applied retroactively and shall enter into force from their date of publication. If you do not agree to the modified terms and conditions of the Booking Site, you must stop using the Service. We recommend that you periodically consult the Terms and Conditions of Use of the Booking Site, as well as the Terms and Conditions of Use of the parking service.


II.- Use of the website, its services and contents

Repsol makes the use of the Booking Site conditional on the previous fulfilment of the corresponding user registration. In any case, registration shall take place in the manner expressly specified in the service itself, the user being responsible for providing accurate information and maintaining the information provided by him or her up to date at all times. The User shall be solely responsible for false or inexact statements made and for the damages caused to Repsol or third parties by the information provided.

The user undertakes to use the Booking Site and its services and contents without violating the provisions of these Terms and Conditions of Use, the Terms and Conditions of Use of the parking service, current regulations, good faith, generally accepted uses and public order. Likewise, use of the website is prohibited for unlawful purposes of purposes harmful to Repsol or any third party or that, in any way, may cause harm or prevent the normal operation of the Website.

Regarding contents (information, text, graphics, sound and/or image files, photographs, designs, etc.), the following actions are prohibited:

  • Their reproduction, copy, distribution, dissemination, public communication, transformation or modification, except where authorised by their legitimate owners or legally permitted.
  • Any violation of the rights of Repsol or its legitimate owners regarding these contents.
  • Their use for any commercial or advertising purposes different from those strictly permitted.
  • Any attempt to obtain the contents of the Booking Site through any means different from those made available to users as well as those usually used on the Internet, as long as these do not cause any harm to the Repsol Website and/or the Services or Content.


III.- User liability for damages

Use of the Booking Site shall be under the sole and exclusive responsibility of the user, with Repsol being expressly held harmless for the damages and/or harm caused to the user or to third parties by said use in violation of the provisions of these Terms and Conditions of Use and the Terms and Conditions of Use of the parking service. This liability shall extend to the use, by the user or by any third party, of any password or similar information assigned to access the site, where applicable, or any of its services.

Notwithstanding the above, Repsol reserves the right to deny, at any time and without the need to provide prior notice, access to the Booking Site for those users breaching these General Terms and Conditions or the Terms and Conditions of Sale applicable in each case.


IV.- Unilateral modification

Repsol may modify, unilaterally and without prior notice, at any time it deems appropriate, the structure and design of the Booking Site, as well as modify or eliminate the services, contents and conditions of access and/or use of the Booking Site.


V.- Hyperlinks

V.1.

Persons or entities seeking to establish or establishing a hyperlink from a webpage of a different website to any of the pages on the Booking Site must abide by the following terms:

  • Total or partial reproduction of any of the services or content of the Booking Site is forbidden.
  • There shall be no deep links, img or other image links or frames with pages of the Booking Site without prior express authorisation from Repsol.
  • There shall be no false, inaccurate or incorrect statements regarding pages of the Booking Site, its employees or the services and content of the Booking Site.
  • Except for signs that are part of the hyperlink, the webpage to which it is linked shall not contain any trademark, trading name, establishment logo, corporate name, logo, slogan or any other distinctive sign belonging to Repsol without express authorisation from the latter.
  • The inclusion of the hyperlink shall not imply the existence of a relationship between Repsol and the owner of the webpage or site where it is included, nor acknowledgement or acceptance by Repsol of the services and content offered on the Booking Site.
  • Repsol assumes no liability for the content or services made available to the public from the webpage or site where the hyperlink is included, nor for the information and statements included therein.
  • The webpage where the hyperlink is included shall not contain any information or content deemed unlawful, contrary to morals and good customs as generally accepted or public order, nor shall it feature content infringing upon the rights of third parties.
  • Any hyperlink to the Booking Site shall link to its homepage or main pages of the sections it contains.
V.2.

The Booking Site may make connections and links to other sites managed and controlled by third parties available to users. Said links serve the exclusive purpose of facilitating user searches for information, content and services on the Internet, this in no case being considered a suggestion, recommendation or invitation. Repsol does not sell, manage, control nor take ownership of the content, services, information and statements available at these websites.

Repsol assumes no liability whatsoever, not even indirect or subsidiary in nature, for damages of any type that may arise from the access, maintenance, use, quality, lawfulness, reliability and usefulness of the contents, information, communications, opinions, statements, products or services existing or offered on websites not managed by Repsol and that may be accessible from the Booking Site.


VI.- Liability and guarantee disclaimer

Repsol provides no guarantee whatsoever, nor assumes any liability, in any case, for damages of any nature that may arise from:

  • The lack of availability, maintenance and effective operation of the Booking Site and/or its services or content.
  • The lack of usefulness, adequacy or validity of the Booking Site and/or its services or content to satisfy specific needs, activities or results or user expectations.
  • The existence of viruses, malicious or harmful software in the content and/or services provided through the Booking Site that may cause alterations in your computer system (software and hardware) or in the electronic documents and files stored by the user.
  • The reception, procurement, storage, dissemination or transmission by users of the contents and the infringement of intellectual and industrial property rights, trademarks, honour, personal and family intimacy, data protection, image, property or any right of third parties as a result of this infringement.
  • Unlawful, negligent or fraudulent use, in violation of these Terms and Conditions of Use, of good faith, of generally accepted uses or public order and of the Booking Site, its services or content, by users.
  • The lack of lawfulness, quality, reliability, usefulness, updating and availability of the services provided by third parties and made available to users on the Booking Site and/or of the content.
  • Non-fulfilment on the part of third parties of their obligations or commitments regarding the services provided to users through the Booking Site.
  • The opinions expressed by users in forums, chats and review messages that may be enabled in different areas of the Booking Site.
  • Knowledge that unauthorised third parties may gain regarding the class, conditions, characteristics and circumstances of the use that users make of the Booking Site and its services and/or content.

VII.- Duration

The duration of the provision of the service of the Booking Site is indefinite.

Notwithstanding the above, Repsol reserves the right to interrupt, suspend or terminate the provision of the service of the Booking Site or any of the services and/or contents comprising it.


VIII.- Intellectual and Industrial Property

All trademarks, trading names or distinctive signs of any nature appearing on the Booking Site are the property of the companies belonging to the Grupo Repsol or of third parties, the use or access of the Booking Site and/or Services not attributing to Users any right over the aforementioned trademarks, trading names and/or distinctive signs.

Likewise, the Contents are the intellectual property of Repsol or of third parties, the User not being understood to have been transferred, by virtue of these Terms and Conditions of Use, any of the operating rights that exist or may exist over said Contents beyond that which is strictly necessary for the proper use of the Booking Site and of the Services.

For the purpose of protecting potential intellectual and industrial property rights, in the event that any user or third party considers that there has been a violation of its legitimate rights due to the introduction of certain content on the Booking Site, it must notify Repsol of this circumstance, specifying:

  • Personal details of the interested party holding the rights allegedly infringed. If the claim is filed by a third party rather than the interested party, this third party must specify the capacity in which it acts.
  • Specification of the content protected by intellectual or industrial property rights and its location on the Booking Site.
  • Evidence of the aforementioned industrial or intellectual property rights.
  • Express statement in which the interested party assumes responsibility for the accuracy of the information provided in the notification.

The trademarks included on the Booking Site are subject to applicable legislation on the matter of intellectual property, their reproduction or use without the authorisation of their owner being prohibited.

Any citation or reference to the intellectual property rights of third parties included on the Booking Site implies recognition by Repsol, in favour of the right holders, of the corresponding intellectual and industrial property rights, with their inclusion or reference on the Booking Site not implying the existence of any right or responsibility for Repsol to them, their inclusion and reference having been duly authorized, pursuant to current regulations, this inclusion not being considered sponsorship or recommendation of the referenced brands by Repsol.

The intellectual property rights to the Website: www.securityparking.repsol.com, as well as to any elements considered works governed by Intellectual Property regulations, belong solely and exclusively to Repsol, with Repsol being the holder of all intellectual property rights.

In its capacity as sole holder of the intellectual property rights over the Booking Site, Repsol is exclusively entitled to exercise the rights stemming from ownership of the website: www.securityparking.repsol.com and, consequently, it has the exclusive capacity to grant authorization for the exercise of any activity deriving from the operating rights and, in particular, the right of reproduction, the right to public communication, the right to distribution, the right to make available to the public or the right of transformation, in any format whatsoever.

Legitimacy of the industrial and intellectual property rights corresponding to the contents supplied by third parties falls under their exclusive responsibility.


IX.- Applicable legislation and jurisdiction

These General Terms and Conditions shall be governed by Spanish legislation.

Repsol and the user, expressly waiving any other legislation that may correspond to them, submit to the Courts of the user's registered address for any questions that may arise or actions that may be brought, arising from the provision of the service of the Site and its services and content and regarding the interpretation and application of, and compliance or non-compliance with, the terms and conditions herein. In the event that the User's registered address is outside Spain, Repsol and the user, expressly waiving
